Terms of Service

1. Who you are contracting with
These Terms of Service ("Terms") are a legal agreement between you and Description LLC ("we", "us" or "our"), the provider of the Description Modifier website and Chrome extension (the "Service").
2. Acceptance
By creating an account, installing the extension, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
3. The Service
Description Modifier lets you bulk find, replace, add, and delete text across your own YouTube video descriptions, using credentials you authorise through Google's YouTube Data API. We provide the Service "as is" and do not guarantee that it will be uninterrupted or error-free.
4. Acceptable use
You agree not to:
- use the Service for any unlawful purpose or to violate any third party's rights;
- use it to send spam, infringe intellectual-property rights, or harass others;
- interfere with the security or integrity of the Service, including by probing, scanning, scraping, or attempting to introduce malware;
- resell, sublicense, or redistribute the Service without our written consent;
- reverse engineer or attempt to circumvent any technical limits.
5. Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.
6. Intellectual property
Description LLC retains all right, title, and interest in and to the Service, including all related software, documentation, branding, and intellectual property. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms and your subscription plan.
7. Payment, billing and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, taxes, subscription renewals, cancellations, and refunds are governed by Paddle's Buyer Terms. Refunds are also subject to our Refund Policy.
8. Suspension and termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, present a security or fraud risk, or repeatedly or seriously violate our policies. You may stop using the Service and cancel your subscription at any time from your account page.
9. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the fullest extent permitted by law, Description LLC's aggregate liability under these Terms will not exceed the fees you paid to us in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, or punitive damages, including loss of profits, data, revenue, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.
11. Indemnity
You agree to indemnify and hold Description LLC harmless from any claim arising out of your misuse of the Service, your violation of these Terms, or your infringement of any third-party right.
12. Changes to the Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
13. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws principles. Disputes will be resolved exclusively in the state or federal courts located in Wyoming, except where mandatory consumer-protection law provides otherwise.
